$3 million settlement in Mill St. pedestrian death

SPRINGFIELD — The family of a 61-year-old man who died after being struck while crossing Mill Street in 2023 has reached a $3 million settlement.

The settlement represents the full limits of the commercial insurance policy and was reached after extensive investigation and preparation, all without filing a lawsuit, according to The Law Offices of Mark E. Salomone.

On the morning of July 28, 2023, the man was crossing Mill Street when a commercial van turned left from Belmont Avenue and struck him, according to the news release. Salamone’s office said the van driver had a clear, unobstructed view of the crosswalk but admitted to rushing because he was late for work.

The crash caused catastrophic injuries, and despite weeks of intensive care at Baystate Medical Center, the man succumbed to his injuries on August 9, 2023.

“This family suffered an unimaginable loss,” said Salomone. “While no amount of money can ever make up for what they’ve endured, this settlement provides them with the security and closure they need to begin moving forward.”

Salamone’s firm collected evidence including police body camera footage, 911 recordings, crash reconstruction reports, and multiple eyewitness accounts.

Evidence showed the victim had been visible in the crosswalk for several seconds before the collision, the release said. Records also revealed the driver was operating the company van with an expired license.

The settlement came in mediation without a lawsuit filed.
