A Saugus man who worked as a commuter rail conductor was convicted Wednesday of manslaughter for killing his estranged wife’s boyfriend as the couple slept in an Everett apartment, court records show.
Jurors acquitted Brian Green, whose father is MBTA Transit Police Chief Kenneth Green, of first-degree murder for the killing of 38-year-old Jarmahl Sutson in July 2022. In addition to manslaughter, Brian Green was also convicted of unarmed burglary and solicitation of a crime punishable by five years or more in prison, records show.
At Green’s arraignment in August 2022, prosecutors said he broke into the home where he and his wife lived in Everett around 4:20 a.m. on July 19 of that year. Green used a key to get in and, in the dark, navigated to the bedroom where he found his estranged wife and Sutson, The Daily Item reported.
Green’s estranged wife, with whom he was in the process of a divorce, called police at 4:22 a.m. after waking up to Sutson in a pool of blood. She also found a shell casing in the bed, the paper reported, citing a police report.
Sutson was the father of Green’s estranged wife’s child.
Prosecutors said Green had a history of violence and anger toward women who tried to leave him, according to The Boston Globe. Before the killing, Green had a firearms offense on his record and had been subject to two domestic violence restraining orders.
Green had tried to cover up his crime by telling family members and friends that he had gone directly from home to work, according to prosecutors.
The verdict was reached on the 11th day of Green’s trial in Middlesex Superior Court, records show. No sentencing date was listed. Manslaughter carries a sentence of up to 20 years in prison.
“Jarmahl Sutson was a father, a son, and a brother. This one unfortunate event will sadly forever impact our family‚” said Michael Satterwhite, a Lynn-based attorney who was Sutson’s cousin, following the arraignment.
