After spending more than two decades incarcerated in Massachusetts, a man’s fate remains uncertain as he is facing Immigration and Customs Enforcement (ICE).
Bryan Marshall, of Chicopee, was 27 when he shot a killed another man, Robert Campbell, who was dating his ex-girlfriend on April 10, 2001.
Marshall was convicted of second-degree murder and was sentenced to life in prison with the possibility of parole.
He was first allowed to ask for parole in 2016 but postponed his hearing. Instead, he faced the Massachusetts Parole Board for the first time on June 18.
His last disciplinary report was in 2010, the parole board noted. He has also completed multiple programs and is awaiting enrollment in the Family Violence Program.
The board considered a neuropsychological evaluation that noted “sustained clinical improvement indicative of substantial, effective rehabilitation.”
On Nov. 19, the board concluded by unanimous decision that Marshall had demonstrated a level of rehabilitation that would make his release compatible with the welfare of society.
Once he completes the Family Violence Program, he will be released to ICE.
If released from ICE, he will have a curfew of 10 p.m., be supervised for drugs and alcohol and must have mental health counseling for adjustment.
At least five others have been released from prison to ICE in the past year. However, ICE has not responded to MassLive’s request for comment if any of them have been deported.
