For the Supreme Judicial Court to dismiss two of the three criminal charges against Karen Read on double jeopardy grounds, justices would essentially have to upend long-standing legal precedent and create new law, legal experts say.
Read is asking the state‘s highest court to drop the charges of second-degree murder and leaving the scene of a crash causing injury or death she faces in connection with the death of her then-boyfriend, Boston police officer John O‘Keefe. She has appealed a lower court’s decision not to do so, arguing that a retrial on those counts would constitute double jeopardy because jurors reached a final, unanimous agreement to acquit her.
