Karen Read’s appeal of a judge’s decision to deny a motion to dismiss two of the three criminal charges she faces will be heard by the full Supreme Judicial Court in November.
Read, 44, is charged with second-degree murder, manslaughter while operating under the influence and leaving the scene of an accident causing injury or death. After her first trial ended in a mistrial in July, Read’s attorneys began receiving communications from jurors indicating they agreed to acquit her of the murder charge and the leaving the scene charge. Based on the supposed agreement from jurors, Read’s attorneys argue that retrying her on those charges would constitute double jeopardy.
