Officer suing Westfield for late wages was actually overpaid, city lawyer says

SPRINGFIELD — Responding to a lawsuit charging that Westfield failed to pay police wages completely or promptly, the city says research shows it has actually overpaid the lead plaintiff, Officer Jason Perron.

In May, Erik Valdes of the city’s Law Department filed a motion to amend its answers to Perron’s original complaint after both sides began the discovery process to prepare for trial. The city then filed a counterclaim.

In the original complaint against the city filed in June 2023, first in Westfield District Court and then transferred to Hampden County Superior Court, Perron alleged the city didn’t pay his wages within seven days of the termination of the pay period during which the wages were earned, and that he and other officers weren’t paid overtime they had earned.
